Terms of User

These Terms of User, together with any referenced documents ("Terms"), govern the use of any and all Petpaws services, including but not limited to the "Petpaws" mobile application and its associated products and services (collectively referred to as the "Platform"), as well as any photos, audio, video, information, text, links, graphics, or other materials or arrangements of materials uploaded, downloaded, or appearing on the Platform (collectively referred to as "Content"). These Terms constitute a legally binding contract between you ("User/You/Your") and Petpaws (as defined below, "We/Our/Petpaws"). By acknowledging acceptance of these Terms or otherwise using the Platform, you enter into a contract with us. If you are signing this contract on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms, in which case "User," "You," or "Your" refers to that entity. If you are not authorized to enter into this contract or disagree with any of the terms or conditions of these Terms, you must not access or use the Platform. By accessing and using the Platform, you explicitly acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Your Account

To access the Platform, you must create an account with us. We may offer different types of accounts. When creating an account, you must provide accurate and up-to-date information about yourself and your pets (e.g., birthdate). If any of your information changes, you agree to promptly update it. You are responsible for ensuring the security of your account and password by selecting a strong password, not sharing it with anyone, and using it solely for this account. If you fail to follow the above recommendations and do not properly protect your account, we will not be liable for any loss or damage.

2. Who Can Use the Platform

These services are available to users aged 18 or older, or those of the legal contract age, whichever is greater. If we suspect you are underage, we may terminate your account without prior notice. If you believe we have made a mistake, you may contact us at support@petpwsnow.com to appeal the termination.

3. User Account and Service Access

To use these services, you will need to create an account with us. Each user establishing such an account must: (1) provide true, accurate, timely, and complete information about the applicable registration form (collectively referred to as "Registration Data"), (2) maintain and promptly update the necessary Registration Data to keep it true, accurate, timely, and complete.

4. Changes and Termination

We reserve the right to modify or change the services, as well as any services or materials provided through the services. We are not liable if the entire service or any part of it is unavailable at any time or for any period. Occasionally, we may limit access to certain parts of the service, including for registered users. If after investigation we have reasonable grounds to suspect that any user's information is false, inaccurate, untimely, or incomplete, we may suspend or terminate that user's access to any and all current or future use of the services. We have the right at any time, at our sole discretion, to suspend or terminate your access based on your selection or any username, password, or other identifier provided by us, including for any reason we believe you have violated any provision of these Terms.

5. How to Use the Platform

This service is a mobile and online platform designed to connect pet enthusiasts. We encourage all connections to start with your beloved pet and suggest using a pet-related photo as your profile picture. If you are interested in other people's profiles on the dynamic square, you can start chatting to get to know each other. Once you connect with your pet, you can choose to share personal photos and other information.

6. What You Cannot Do

Engage in any illegal activities or any activities that violate these Terms, national or international laws, treaties, rules, and regulations;

Exploit or engage with animals, humans, or minors in any inappropriate or harmful manner;

Circumvent any technical restrictions of the platform's software or reverse engineer, alter, decompile, or disassemble the platform's software;

Use any automated systems or software to extract any data or content from the platform;

Send spam messages to other users or their pets;

Share other users' personal or confidential information in an inappropriate manner;

Unauthorized use or attempt to use other users' accounts;

Post or share the following content: (i) illegal; (ii) spread harmful misinformation or hate speech; (iii) insult or harm animals, humans, or minors; (iv) pornographic, provocative, obscene, or sexual content, or promote explicit pornography; (v) infringe upon the rights of others, including but not limited to intellectual property rights, human rights, animal rights, privacy rights, and/or rights of publicity; (vi) discriminate based on nationality, race, ethnicity, religion or belief, sexual orientation, gender identity, gender, disease or disability, or age; (vii) promote violence against animals or humans; (viii) include any form of threats, intimidation, or harassment; (ix) cause harm to animals, the environment, and/or humans in any other way.

We reserve the right to remove any content that we believe violates these Terms or is harmful to animals, humans, and/or other users, without prior notice to you and without any liability. Furthermore, if we find or suspect that you have not complied with the above provisions or otherwise violated these Terms or any other rules, laws, or regulations, we reserve the right to suspend or terminate your account, without prior notice to you and without any liability.

We have a content moderation system in place, where our moderation team manually reviews reported content and ensures it complies with the platform's terms. Users who repeatedly violate the platform's terms may face account suspension or termination. Any content found to violate these terms will be promptly reviewed and removed by our moderation team.

7. User Blocking Mechanism

Users have the ability to block other users who engage in abusive or inappropriate behavior. Once a user is blocked, they will no longer be able to contact the user who blocked them or access their profile.

The platform encourages users to report any suspicious or harmful behavior via the blocking and reporting tools available within the app.

8. Reporting

You can report any suspected illegal content or content that violates these Terms by sending an email to support@petpwsnow.com or clicking the "Report" section in the Petpaws app. Users can report any inappropriate content or behavior by using the built-in reporting tool, and the platform will review and act upon these reports promptly to ensure a safe environment. In case of receiving a report about abusive or objectionable content, the developer commits to reviewing the reported content and taking appropriate action within 24 hours, which may include removing the content and suspending or banning the user responsible for submitting the content.

9. Your Content Rights

We do not own your content — it always belongs to you. You are responsible for the content you create and post on the platform, and you should ensure that you have all the necessary rights to do so. For example, some of the content you share or upload may be protected by intellectual property laws. You retain ownership of the intellectual property rights in any original content you create, and nothing in these Terms will deprive you of your rights.

We are not responsible for content created or shared by you or other users. We cannot guarantee that content on the platform will meet your needs, be appropriate, harmless, legal, non-infringing on third-party rights, or accurate. We do not monitor or endorse user-created or shared content, and we are not liable for any losses or damages caused by such content or events beyond our reasonable control. However, we commit to taking prompt action to remove or restrict access to any content that violates these Terms, is illegal, or harmful, and will prevent it from being uploaded again on the platform.

10. Free Disclaimer and Limitation of Liability

You use the platform and access any content at your own risk. All content you create remains your personal property. Petpaws is not liable for such content. By uploading content, you represent and warrant that you have obtained all necessary permissions, authorizations, consents, and agreements from Petpaws and third parties for the lawful use of such content as required by these Terms for the provision of the platform and related services.

Petpaws does not control or guarantee the accuracy, completeness, or quality of content posted by you or other users. You agree that you must assess and assume all risks associated with using third-party content, including any reliance on the accuracy, completeness, or usefulness of such content.

In any case, Petpaws is not liable for any content, including but not limited to any errors or omissions in the content, or any losses or damages arising from using any content created, posted, or shared on the platform.

11. Intellectual Property

These services and all their content, features, and functionalities (including but not limited to all information, software, text, displays, images, video, and audio, as well as their design, selection, and arrangement) are owned by Petpaws, its licensors, or other content providers and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary laws.

Respecting intellectual property is crucial on our platform. We encourage you to respect third-party intellectual property and avoid infringing upon their rights, whether or not they are platform users. You may encounter different forms of intellectual property rights on Petpaws, including copyrights and trademarks, but also patents, industrial designs, and utility models.

12. Trademark Information

These Terms strictly prohibit the use of "Pet" or other marks, logos, names, and symbols on the service without the prior written consent of the applicable owner. All other names, logos, product and service names, designs, and service slogans are trademarks of their respective owners.

Infringing on third-party trademarks may result in content removal, and repeated violations may lead to the suspension or termination of your account. We also reserve the right to restrict access, suspend, or terminate any future accounts you create with us if we determine that you have repeatedly infringed upon others' trademarks.

13. Privacy

The information we collect about your use of the services is governed by our current privacy policy. Petpaws agrees to handle your personal identifying information in accordance with our privacy policy, which forms part of these Terms. By using the services, you consent to the actions we take regarding your data as outlined in the privacy policy.

14. Termination of These Terms and Our Relationship

You may terminate the agreement with Petpaws at any time by deleting your account. However, some of the content you have posted on the platform may still be available after deleting your account, depending on other users' permissions or authorization to use it.

If any of the following occur, we may limit access, suspend, or terminate your account and any content you have created or shared on the platform without prior notice and without any liability to you:

(i) We determine or reasonably believe that you have violated these Terms;

(ii) We are legally obligated to do so;

(iii) We encounter technical or security issues;

(iv) Your account has been inactive for an extended period or you have not logged in for a long time; or

(v) Any other reason we deem sufficient.

In such cases, we may reclaim your account name and make it available to other users. If we previously determined that you violated these Terms, we also reserve the right to restrict access, suspend, or terminate any future accounts you create with us.

We will make reasonable efforts to notify you through the email address associated with your account or via platform features, but we are not obligated to do so. If you believe your account and/or content has been suspended or deleted in error, you may appeal our decision through platform features or contact us via the following email: support@petpaws.com. You must provide a full explanation of the reason for your request, and we will review it and make a final decision promptly.

For the avoidance of doubt, these Terms remain valid even after your account is deactivated or terminated.

15. Amendments to the Terms and Changes to the Platform

We may revise these Terms and/or make changes to the platform from time to time. We will attempt to notify you of significant revisions/changes via email or the mobile app. However, if these revisions and/or changes are urgent, such as for fixing security or technical issues, we may not be able to notify you in advance. If you do not agree with any part or all of the revisions to the Terms or platform changes, you should stop using our services. Continued access to or use of the platform means you agree to be bound by the revised Terms.
